1. Role of RT Creations

RT Creations provides custom product design, manufacturing, printing, fulfillment, fundraising support, online shop setup, and related services. Depending on the project, RT Creations may assist with custom designs, product production, order collection, payment processing, bulk delivery, direct shipping, or event support.

For fundraising programs, RT Creations acts as an independent third-party manufacturing and fulfillment provider. Unless otherwise agreed in writing, the fundraising organization is responsible for promotion, participant communication, and final distribution after bulk delivery.

2. Custom Orders

Custom items are made specifically for each customer, group, organization, or event. Customers are responsible for reviewing all order details, including spelling, names, colors, quantities, dates, logos, and design requests before production begins.

Once a custom order has been approved or production has started, changes may not be possible and additional fees may apply.

3. Fundraising Programs

RT Creations may offer fundraising support through online remote fundraisers, in-person fundraising events, or bulk orders at a discounted rate.

For online fundraisers, RT Creations may create or manage an order page, collect orders, produce products, and deliver completed orders according to the fundraiser setup.

For in-person events, RT Creations may provide exclusive designs, products, production support, and/or event sales support depending on the agreement.

For bulk order fundraisers, RT Creations may sell products to the organization at a discounted rate. The organization may then resell those products at its chosen price and retain the difference as fundraising profit.

4. Fundraising Disclaimer

RT Creations is not a charitable organization and does not provide tax, accounting, or legal advice. RT Creations does not guarantee fundraising totals, participation levels, sales volume, profit amounts, or donation outcomes.

Fundraising proceeds, donation structures, pricing, deadlines, and distribution responsibilities may vary by fundraiser and should be confirmed in writing between RT Creations and the fundraising organization.

5. Bulk Delivery to Organizations

When orders are delivered in bulk to a fundraising organization, school, team, business, club, or designated representative, RT Creations’ delivery obligation is considered fulfilled once the order is transferred to that representative.

After transfer, the organization is responsible for sorting, distributing, storing, and delivering items to individual participants or customers. RT Creations is not responsible for loss, misplacement, delay, or non-delivery after confirmed bulk transfer.

6. Direct Shipping

When RT Creations ships directly to an individual customer, the customer is responsible for providing complete and accurate shipping information.

Risk of loss transfers to the customer once the shipping carrier confirms delivery. RT Creations is not responsible for lost, stolen, delayed, misdelivered, or damaged packages after carrier acceptance or confirmed delivery.

Damage or loss claims may need to be processed through the shipping carrier. Replacements may only be issued after a carrier claim is reviewed and approved.

7. Final Sale, Refunds & Replacements

Because most RT Creations products are custom-made, personalized, printed, engraved, produced on demand, or created for a specific fundraiser or event, all sales are final unless otherwise stated in writing.

Refunds, exchanges, or replacements may be considered only for verified manufacturing defects reported within a reasonable time after receipt. Minor color, material, placement, or handmade variations are not considered defects.

8. Product Variations

Custom products may vary slightly from digital previews, mockups, samples, or photographs. Colors may appear different due to screen settings, lighting, material differences, sublimation processes, UV printing, engraving, 3D printing, filament batches, or handmade production methods.

These normal variations are part of the custom production process and do not qualify as defects.

9. Customer-Supplied Artwork, Logos & Content

Customers and organizations are responsible for ensuring they have the right to use any logos, names, trademarks, artwork, images, phrases, or other materials submitted to RT Creations.

By submitting content, you represent that you have permission to use it and authorize RT Creations to use it for design, production, mockup, fulfillment, and related order purposes.

10. Intellectual Property & Design Ownership

Original artwork, layouts, mockups, renderings, 3D models, engraving files, print files, composite designs, templates, and custom design work created by RT Creations remain the property of RT Creations and/or 216 Ventures LLC unless otherwise agreed in writing.

Unauthorized reproduction, resale, duplication, digital recreation, reverse engineering, redistribution, or commercial use of RT Creations design files or mockups is prohibited.

11. Payment Processing & Chargebacks

Payments may be processed through third-party providers such as Square, HubSpot, Stripe, PayPal, or similar services. RT Creations does not store full credit card information.

In the event of a failed payment, dispute, or chargeback, production may be paused, orders may be delayed, fundraising totals may be adjusted, and RT Creations may seek recovery of fees, costs, or unpaid balances where permitted by law.

12. Production Timelines

Production timelines, delivery dates, fundraiser close dates, and shipping estimates are estimates only and are not guaranteed unless expressly stated in writing.

Delays may occur due to supply availability, equipment issues, high order volume, design approval delays, weather, carrier delays, labor shortages, or circumstances outside our control.

13. Product Use & Safety

Products may contain small parts and may not be suitable for children under three years of age unless expressly labeled. Products are not toys unless specifically identified as such.

Customers are responsible for safe use, proper care, and appropriate handling. RT Creations is not liable for misuse, improper cleaning, alteration, modification, or use outside the intended purpose.

14. Warranty Disclaimer

Products and services are provided “as is” and “as available.” To the fullest extent permitted by law, RT Creations disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of Liability

To the fullest extent permitted by law, RT Creations and 216 Ventures LLC shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost fundraising revenue, event delays, reputational harm, or business interruption.

Total liability for any claim shall not exceed the amount paid for the specific order or service giving rise to the claim.

16. Indemnification

Customers, partners, and fundraising organizations agree to indemnify, defend, and hold harmless RT Creations and 216 Ventures LLC from claims arising out of unauthorized logo or trademark use, submitted content, fundraising disputes, distribution issues, customer communications, tax matters, resale activities, or misuse of products.

17. No Partnership or Agency Relationship

Nothing in these Terms creates a partnership, joint venture, employment, franchise, or agency relationship between RT Creations and any customer, organization, fundraiser, or partner. RT Creations operates as an independent business.

18. Taxes

Customers and organizations are responsible for any tax reporting, donation reporting, resale compliance, sales tax obligations, or other legal requirements related to their fundraiser, resale activity, or organization.

19. Website Availability

RT Creations does not guarantee uninterrupted access to websites, online order pages, fundraising pages, payment platforms, or forms. RT Creations is not liable for downtime, technical issues, third-party service interruptions, or payment processor outages.

20. Force Majeure

RT Creations shall not be liable for delays or failure to perform caused by events beyond reasonable control, including severe weather, natural disasters, carrier disruptions, supply shortages, equipment malfunction, labor shortages, power outages, government actions, or emergencies.

21. Age Requirement

You must be at least 18 years old to place an order or submit a request. If you are under 18, a parent or legal guardian must complete the transaction.

22. Governing Law & Venue

These Terms are governed by the laws of the State of Ohio. Any dispute shall be brought in the state or federal courts located in Cuyahoga County, Ohio, unless otherwise required by applicable law.

23. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

24. Updates to These Terms

RT Creations reserves the right to update or amend these Terms at any time. Updated Terms become effective when posted. Continued use of our website, services, fundraising pages, or order forms constitutes acceptance of the revised Terms.

25. Electronic Agreement

Placing an order, submitting a form, approving a design, making a payment, or participating in a fundraiser electronically constitutes acceptance of these Terms and is equivalent to a written signature.
